Terms of Service
Please read these Terms of Service (“Terms”) carefully before using wurk (“Service”) operated by Wurk, Inc. (“we,” “us,” or “our”). By accessing or using the Service, you agree to be bound by these Terms.
1. Acceptance of Terms
By creating an account or using the Service in any way, you confirm that you are at least 18 years old, have the legal authority to enter into this agreement, and agree to these Terms in full. If you are using the Service on behalf of an organization, you agree to these Terms on behalf of that organization.
2. Accounts
You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to notify us immediately of any unauthorized use. We reserve the right to suspend or terminate accounts that violate these Terms or that have been inactive for an extended period.
3. Credits and Billing
The Service operates on a credit-based system. Credits are purchased in advance and consumed when builds are executed. The credit cost of each build is shown to you before you approve it — you will never be charged more than the displayed amount for an approved build.
Unused credits from a completed build are automatically returned to your account. Credits expire 12 months from the date of purchase. Subscription plans renew monthly and include a per-credit rate discount. Subscriptions can be cancelled at any time; the cancellation takes effect at the end of the current billing period.
All fees are non-refundable except where required by law or at our sole discretion.
4. Intellectual Property
You retain full ownership of the software and code generated for you through the Service. We claim no intellectual property rights over your generated output. The underlying platform, tooling, and infrastructure that power the Service remain the property of Wurk, Inc.
By using the Service, you grant us a limited license to process your inputs solely for the purpose of delivering the Service to you.
5. Acceptable Use
You agree not to use the Service to:
- Violate any applicable laws or regulations
- Generate malware, spyware, or other malicious software
- Infringe on the intellectual property rights of others
- Harass, abuse, or harm any person or organization
- Attempt to circumvent the Service’s security or billing systems
- Resell or sublicense access to the Service without written permission
6. Limitation of Liability
The Service is provided “as is” without warranties of any kind, express or implied. To the fullest extent permitted by law, Wurk, Inc. shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities, arising from your use of or inability to use the Service.
Our total liability to you for any claim arising from these Terms or your use of the Service shall not exceed the amount you paid us in the 12 months preceding the claim.
7. Termination
You may terminate your account at any time by contacting us or through your account settings. We reserve the right to suspend or terminate your account at any time, with or without notice, if we believe you have violated these Terms or if required by law. Upon termination, your right to use the Service ceases immediately.
8. Changes to Terms
We may update these Terms from time to time. When we do, we will update the “Last updated” date at the top of this page and, for material changes, notify you by email or through the Service. Continued use of the Service after changes take effect constitutes your acceptance of the revised Terms.
9. Governing Law
These Terms are governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved in the state or federal courts located in Delaware, and you consent to the personal jurisdiction of those courts.
